Terms of Service – AhliWeb.com

Welcome to AhliWeb.com, a service of PT Ahli Web Internasional ("AhliWeb," "we," "our," or "us"). These Terms of Service ("ToS") constitute a legally binding agreement between AhliWeb and any natural or legal person ("you," "User") who accesses or uses our Services.

By creating an account, purchasing a plan, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by the following four documents (collectively the “Agreement”):

Terms of Service (this document) – contractual backbone.
Privacy Policy – how we collect, use, store, and share personal data.
Acceptable Use Policy (AUP) – permissible and impermissible activities.
Billing Policy – invoicing, payments, refunds, and price changes.

0. Shariah Principles

All Services, fees, and contractual relationships must avoid elements of riba (interest), gharar (excessive uncertainty), and maysir (gambling/speculation).
Administrative penalties reflect actual operational costs and are not interest-bearing.
Users may not host, promote, or facilitate content or transactions deemed haram by credible Indonesian or international fatwas.
In case of conflict with Shariah rulings, the parties shall seek an amicable, Shariah-compliant adjustment before litigation.

1. Definitions

“Services” means all hosting, cloud, SaaS, domain, e-mail, development, consulting, and related offerings provided by AhliWeb; “Client” means an end-user purchasing Services for personal or organisational use; “Reseller” means a User authorised to resell Services to Sub-Clients; “Collaborator” means any partner engaging in joint development, integration, or project cooperation with AhliWeb; “Content” refers to all data uploaded, stored, or transmitted via the Services.

2. Acceptance & Document Hierarchy

Master Contract – These ToS are the primary contract and prevail over any conflicting provision in the companion documents unless a companion document expressly overrides them.
Companion Documents – The Privacy Policy, AUP, and Billing Policy are incorporated by reference and may be updated independently (Section 15).
Product-Specific Addenda – Order Forms, Statements of Work (SOW), and Service Level Agreements (SLA) supplement, but do not replace, the Agreement.

3. Scope of Services

We provide web hosting, domain registration, application development, ERP/CRM integration, cybersecurity consultancy, and other digital or professional services, each described on our website or in an Order Form.

4. Account Registration & Security

You must provide accurate, up-to-date information and maintain the confidentiality of your credentials. You will promptly notify [email protected] or WhatsApp +62‑895‑1338‑0400 of any unauthorised access or other security incidents.

5. User Obligations (AUP Reference)

You shall comply with the AUP at all times. Prohibited Content includes, but is not limited to, illegal, infringing, haram, or resource-abusive material. Breach may result in suspension or termination without refund.

6. Special Clauses per User Segment

6.1 Clients

SLA – 99.5% monthly uptime for shared/cloud hosting. Credit of 5% monthly fee for each additional 1% downtime (capped at 50%).
Data Portability – You may request a full backup once per billing cycle.

6.2 Resellers

You may white-label Services provided you include “Powered by AhliWeb.com” in the footer unless you subscribe to the Enterprise Reseller tier.
You are fully responsible for Sub-Client compliance with the Agreement.
Commission & volume discounts are governed by the Billing Policy and the Reseller Schedule.

6.3 Collaborators / Partners

Joint work will be outlined in a separate SOW.
Intellectual Property created jointly shall be co-owned 50% / 50% unless otherwise agreed in writing.
Non-Solicitation – Neither party will solicit or hire the other’s personnel engaged in the project during the term and twelve (12) months thereafter.

7. Billing & Fees

Billing matters—including invoicing, payment methods, money-back guarantees, late fees, and price adjustments—are governed by the Billing Policy, which forms part of the Agreement.

8. Service Level Commitment (SLA)

SLA credits (Section 6.1) are your sole and exclusive remedy for downtime.

9. Suspension & Termination

We may suspend or terminate Services immediately if you breach any part of the Agreement or fail to pay fees. Termination for cause forfeits any refund. You may cancel by emailing [email protected] at least ten (10) business days before renewal.

10. Back-ups & Data Portability

We perform routine server backups for disaster recovery. You remain solely responsible for maintaining current backups of your Content.

11. Indemnification

You agree to indemnify, defend, and hold harmless AhliWeb, its directors, employees, and affiliates from any claim or liability arising from your Content or misuse of the Services.

12. Limitation of Liability

To the fullest extent permitted by law, AhliWeb’s aggregate liability under the Agreement shall not exceed the fees paid by you during the six (6) months preceding the event giving rise to the claim. AhliWeb is not liable for indirect, incidental, or consequential damages.

13. Intellectual Property

All AhliWeb trademarks, software, and documentation remain our exclusive property. You grant us a non-exclusive licence to host and process your Content solely for providing the Services.

14. Confidentiality & Non-Solicitation

Each party shall keep confidential information received under this Agreement for five (5) years after termination, unless disclosure is required by law. Non-Solicitation obligations are set out in Section 6.3.

15. Amendments

We may amend these ToS by posting an updated version on our website and sending notice fourteen (14) days in advance for material changes. The AUP, Privacy Policy, and Billing Policy may be updated independently on similar notice periods. Continued use of the Services after changes become effective constitutes acceptance.

16. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the Republic of Indonesia. Any dispute shall first be attempted to be resolved amicably through mediation; failing which, the exclusive jurisdiction lies with the District Court of Kotawaringin Barat.
